General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all orders placed by consumers and businesses through the Litusccoronline store.

The provider and contractual partner is:

Samil Weidenauer / Litusccor
Am Besenberg 15
29451 Dannenberg
Germany
Email: litusccor@gmail.com

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.

2. Conclusion of the Contract

The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order.

The customer may select the desired products and add them to the shopping cart. Before completing the order, the information entered can be reviewed and, if necessary, changed.

By clicking the final order button, the customer submits a binding order for the goods contained in the shopping cart.

The contract is concluded when Litusccor accepts the order by sending an order confirmation or dispatching the goods. Where, for a particular payment method, the contract is concluded upon initiation or completion of the payment process, the conditions displayed during the checkout process shall apply.

3. Prices and Payment Terms

All prices displayed in the online store are total prices in euros and include the legally applicable value-added tax (VAT), where applicable.

Any additional shipping costs will be displayed to the customer before the order is completed.

The payment methods currently available will be displayed during the checkout process.

Payment is due immediately upon conclusion of the contract unless otherwise specified for the respective payment method.

4. Delivery and Shipping

Delivery will be made to the delivery address provided by the customer during the checkout process.

Estimated production and delivery times are stated on the respective product page or during the checkout process.

If delays occur due to circumstances beyond Litusccor's control, the customer will be informed where necessary.

Partial deliveries are permitted provided that they are reasonable for the customer and do not result in additional shipping costs.

5. Custom-Made Products and Customer Designs

Litusccor may offer customers the option to submit their own artwork, images, or designs for the production of customized products.

The customer is responsible for ensuring that the content provided is suitable for the intended production and does not infringe the rights of third parties.

In particular, the customer confirms that they possess the necessary rights to use, reproduce, and process the submitted content. This applies in particular to copyrights, trademark rights, and personality rights.

Litusccor reserves the right to reject submitted content where there are specific indications that its production or use would violate applicable law or the rights of third parties.

For custom-made products, minor variations in color, appearance, or positioning may occur where these are technically unavoidable and reasonable for the customer.

6. Right of Withdrawal

Consumers generally have the statutory right of withdrawal.

Details regarding the right of withdrawal, withdrawal periods, and returns are set out in Litusccor's separate Right of Withdrawal Policy.

For goods that are not prefabricated and for the production of which an individual choice or specification by the consumer is decisive, or which are clearly tailored to the consumer's personal needs, the statutory right of withdrawal may be excluded.

This may apply in particular to products manufactured individually on the basis of artwork or a design provided by the customer.

7. Retention of Title

The delivered goods remain the property of Litusccor until the purchase price has been paid in full.

8. Transport Damage

Customers are requested to report goods with obvious transport damage to the delivery service as soon as possible and to inform Litusccor accordingly.

Failure to make such a complaint does not affect consumers' statutory warranty rights.

9. Liability for Defects

Statutory rights regarding liability for defects apply.

If a product is defective or damaged, the customer may contact Litusccor at litusccor@gmail.com.

In the event of justified defects, customers are entitled to their statutory rights, in particular the statutory right to subsequent performance and, where the statutory requirements are met, a price reduction, withdrawal from the contract, or damages.

10. Product Representation and Color Variations

Litusccor makes every effort to display the products offered as accurately as possible.

Due to differences in screen settings, display technologies, or lighting conditions, colors and contrasts of the actual product may vary slightly from the digital representation shown in the online store.

Minor variations that are technically unavoidable and reasonable do not constitute a defect, provided that the applicable statutory requirements are met.

11. Liability

Litusccor shall be liable without limitation in cases of intent and gross negligence as well as for damages resulting from injury to life, body, or health.

In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to foreseeable damages typical for this type of contract, to the extent permitted by law.

Statutory provisions, in particular mandatory provisions under product liability law, remain unaffected.

12. Copyright

The designs, artwork, images, texts, graphics, and other content displayed on the website may be protected by copyright or other applicable intellectual property rights.

Any reproduction, modification, distribution, or other use beyond the limits permitted by law requires the appropriate authorization or consent of the respective rights holder.

The purchase of a product does not grant the customer any additional rights of use or exploitation relating to the designs or other protected content appearing on the product.

13. Contract Language

The language available for the conclusion of the contract is German.

Where the online store is offered in additional languages, additional contract languages may be available in accordance with the version provided during the respective checkout process.

14. Applicable Law

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

15. Dispute Resolution

Information regarding any willingness or obligation to participate in dispute resolution proceedings before a consumer arbitration board will be provided in accordance with the applicable statutory requirements.

16. Final Provisions

If the customer is a business, a legal entity under public law, or a special fund under public law, the statutory or validly agreed provisions regarding jurisdiction and place of performance shall apply.

In all other respects, the applicable statutory provisions shall apply.
